The agreement between you and Watson Legacy Group LLC

1. Who you're dealing with

New Parent Command Center™ ("the app") is published by Watson Legacy Group LLC ("we", "us"), a Delaware limited liability company, operating as WLG Kids. Watson Legacy Group LLC is the seller of record for everything sold here. Reach us at watsonlegacygroup@gmail.com or 1207 Delaware Ave #3607, Wilmington, DE 19806.

By using the app you agree to these terms. If you don't agree, don't use it.

2. What this is

The app is an organizing tool for parents and caregivers. It records what you type in and shows it back to you. That is the entire function.

It is not: a medical device, a medical service, a health record system, a diagnosis tool, a dosing tool, a therapy or counseling service, a mental health treatment, a monitoring service, an emergency service, or a substitute for a pediatrician, pharmacist, physician, therapist, or emergency responder.

We make no claim, promise, or guarantee about your child's sleep, feeding, health, growth, behavior, or development, and nothing in the app should be read as one.

3. You're the adult here

The app is for adults 18 or older. It is operated by parents and caregivers. It is not directed to children, it does not create accounts for children, and children do not log into it.

Every decision about your child is yours. You are responsible for what you enter, for checking that it's correct, and for what you do next. We are not part of that decision.

4. Your data is your job

Care records are stored in this browser on this device. If you create a caregiver link, an encrypted copy of the selected care records is uploaded to the relay. The relay can also hold encrypted caregiver updates until imported and acknowledged, or until the link expires or is revoked. The encryption key stays in the link fragment and is not sent to the relay by the app. We cannot read that encrypted care content or recover your local records for you; keep your own backup.

Local storage is not permanent. It can be erased by clearing your browsing data, by private browsing sessions ending, by browser or system updates, by low-storage cleanup, by uninstalling the browser, or by losing the device. If you want to keep your records, export a backup and keep the file. We are not liable for records you lose.

5. Acceptable use

Don't resell, sublicense, rent, or redistribute the app or access to it. Don't copy or repackage it as your own. Don't try to break, bypass, or interfere with access controls. Don't use it unlawfully or to harm anyone. We may suspend or end access that breaks these terms.

6. What belongs to whom

The app, its design, its text, and its underlying code belong to Watson Legacy Group LLC. Paid access grants you a personal, non-exclusive, non-transferable licence to use the app for your own household. It doesn't transfer ownership of anything.

Your records belong to you. We never claim any interest in them. Optional caregiver sharing sends encrypted care content to the relay as described above and in the Privacy Policy.

7. Who a profile can be

New Parent Command Center™ supports three kinds of profile: a child, an adult you help care for (Legacy Care™), or yourself. In every case the account holder is an adult who is responsible for what they enter and who they share it with. If you keep a profile about another adult, you confirm you have their agreement or the legal authority to do so; Watson Legacy Group LLC cannot verify that and takes no position on it. Nothing in this app creates a caregiving, guardianship, custodial, or professional relationship between you and Watson Legacy Group LLC.

8. Caregiver links

Paid access lets you create a caregiver link. You control who gets it, what it allows, how long it lives, and when it dies. The link itself is the access: anyone holding the complete link can open the shared board while it is live. You are responsible for who you send it to, and for revoking it when their help ends. Caregiver links relay encrypted data as described in the Privacy Policy; they are a convenience for family organization and are not a monitoring, supervision, safety, or emergency system, and no one at Watson Legacy Group LLC watches them.

9. Links out

The app links to third parties — crisis and support organizations, a payment provider, and other WLG Kids products. We don't control them and aren't responsible for them. Crisis and support lines are independent services run by other organizations. We are not affiliated with them, do not operate them, do not fund them, and cannot see, receive, or intercept anything you say to them.

10. As-is

The app is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We don't warrant that it will be uninterrupted, error-free, or that anything you enter will be preserved.

11. Limits

To the fullest extent the law allows, Watson Legacy Group LLC is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, lost records, lost profits, or lost time, arising from your use of the app. Our total liability for any claim is limited to the greater of the amount you actually paid us in the twelve months before the claim, or twenty-five US dollars.

Some jurisdictions don't allow certain exclusions or limitations. Where that's true, those exclusions or limitations don't apply to you, and nothing here limits liability that cannot be limited by law.

12. Indemnity

You agree to indemnify and hold harmless Watson Legacy Group LLC, its owner, and anyone working with it against claims, damages, losses, and reasonable legal costs arising from your use of the app, your records, or your breach of these terms.

13. Disputes — read this one

Arbitration. Any dispute between you and Watson Legacy Group LLC arising out of or relating to the app or these terms will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Arbitration will be conducted in New Castle County, Delaware, or by telephone, video, or documents-only submission where the rules allow it.

Class action waiver. Disputes will be brought only in your individual capacity. You and Watson Legacy Group LLC each waive any right to bring or participate in a class, collective, consolidated, or representative action. If this waiver is held unenforceable as to a particular claim, that claim proceeds in court and the rest of this section still applies to every other claim.

Small claims. Either of us may bring an individual claim in small claims court instead, if it qualifies.

Opt out. You can reject this arbitration agreement by emailing watsonlegacygroup@gmail.com with the subject line "Arbitration Opt-Out" within 30 days of your first purchase. Include your name and the email you purchased with. Opting out costs you nothing and affects nothing else.

14. Governing law

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Where a claim is not subject to arbitration, the exclusive venue is the state or federal courts sitting in New Castle County, Delaware.

Nothing here removes any right you have under mandatory consumer-protection law in your own jurisdiction.

15. Changes

We may update these terms. The date below shows the current version. Material changes to paid plans apply from your next renewal, not retroactively. Continuing to use the app after an update means you accept it.

16. If part of this fails

If any provision is found unenforceable, it's modified to the minimum extent needed to make it enforceable, or severed. Everything else stands. Our not enforcing something isn't a waiver of it.
